CLARITY Act Failure Fuels Crypto Rally and Uncertainty

The US CLARITY Act failed to secure the 60 Senate votes needed to advance, triggering a stronger-than-expected crypto market response. Bitwise CIO Matt Hougan said the market may be better off without the CLARITY Act because its proposed compromises could have introduced new restrictions. In the three weeks after the 15 September Senate vote, Bitcoin (BTC) rose about 11% and Ethereum (ETH) gained roughly 12%. Hougan also cited a broader altcoin rally: NEAR rose 125%, Uniswap’s token (UNI) gained 49%, and Avalanche (AVAX) advanced 44%. Total crypto market capitalisation recovered from about $2.65 trillion to $2.95 trillion. The CLARITY Act could have restricted interest or rewards on stablecoin balances, created a national licensing system for spot crypto exchanges and limited platforms that combine exchange and brokerage services. With the CLARITY Act stalled, firms such as Coinbase and Kraken can continue operating under the existing framework, including stablecoin yield products for now. The setback was followed by more flexible regulatory action. The SEC introduced a five-year innovation exemption for certain blockchain-based trading of tokenised US stocks and clarified that announcing a buyback for an established crypto network does not automatically make its token an investment contract. Strategy co-founder Michael Saylor also urged crypto firms to develop compliant products under existing rules rather than accept restrictive legislative compromises. The CLARITY Act failure is a mildly bullish short-term signal for crypto prices, as traders avoided potentially restrictive rules. However, the sector remains dependent on agency guidance rather than durable legislation. A future SEC or CFTC leadership change could reverse the current approach, leaving long-term compliance and market-structure risks elevated.
Bullish
The immediate price impact is bullish. Traders interpreted the CLARITY Act’s failure as the removal of potentially restrictive provisions, particularly limits on stablecoin rewards, exchange licensing and combined exchange-brokerage services. This helped support a broad rally in BTC, ETH and major altcoins, while total crypto market capitalisation also recovered. The SEC’s more flexible guidance on tokenised equities and token buybacks added to the positive sentiment. Historical market reactions to regulatory setbacks can be volatile, but when investors believe a proposed law would impose higher compliance costs, its failure can produce relief buying. The sharp gains in NEAR, UNI and AVAX indicate that risk appetite extended beyond Bitcoin and Ethereum. The longer-term outlook is less certain. The CLARITY Act’s failure delays a durable market-structure framework and leaves firms reliant on agency guidance. A change in SEC or CFTC leadership could bring stricter enforcement, reverse current interpretations or reduce the availability of stablecoin yield products. Therefore, the news is bullish for near-term trading momentum, but regulatory uncertainty remains a source of future volatility.
