CLARITY Act Faces Hurdles in Lame-Duck Session
US House Financial Services Committee Chairman French Hill says Congress needs to pass the CLARITY Act to establish lasting rules for digital assets and help the US remain competitive in blockchain technology. SEC and CFTC actions under existing authority have advanced crypto oversight, he says, but cannot replace legislation that a future administration could not change as easily.
The Senate recently voted 49-50 on a motion to begin debate, falling short of the 60 votes needed; this was not a final vote on the bill. Hill hopes for passage during the post-election lame-duck session, although the Senate has only 22 scheduled session days and disputes over ethics safeguards and other provisions remain. The House passed its version in July 2025, and any substantially different Senate bill would need to be reconciled with it. The CLARITY Act would give the CFTC greater oversight of qualifying spot digital commodity markets, while securities-related activity would remain under the SEC. Seven commissioner vacancies across the SEC and CFTC add uncertainty. For crypto traders, the bill’s prospects remain a longer-term regulatory catalyst, but near-term uncertainty is likely to persist.
Neutral
The CLARITY Act could eventually reduce regulatory uncertainty for the US digital-asset industry, but the news does not establish a direct near-term price catalyst for any specific cryptocurrency. The Senate vote was procedural and failed to advance debate, while unresolved provisions, limited session time and the need to reconcile Senate and House versions make passage uncertain. In the short term, traders may react to legislative headlines, but the outcome is more likely to affect sentiment and volatility than to drive a sustained move in a particular coin. Over the longer term, a clear division of SEC and CFTC oversight could support market confidence and participation; however, the effect would depend on the final legislation and its implementation. With no named cryptocurrency or immediate change in market rules, the expected price impact on individual crypto assets is neutral.
