Court Denies Kalshi Injunction in Nevada Sports Betting Case
The US Ninth Circuit Court of Appeals ruled that Kalshi failed to show that federal regulations override Nevada’s authority to regulate sports betting. As a result, Kalshi is not entitled to a preliminary injunction blocking state oversight of its sports and election event contracts.
The Nevada Gaming Control Board had ordered Kalshi to stop offering contracts linked to elections and sporting events in the state. It also warned that civil or criminal action could follow if the platform continued operating.
Kalshi sued the regulator and Nevada, arguing that federal law protected its event-based contracts. A district court initially granted Kalshi an injunction, but later revoked it after a ruling involving Crypto.com. The appellate decision leaves Nevada free to pursue regulatory or legal action against Kalshi. The case highlights growing legal uncertainty for prediction markets and event-contract platforms operating in the US.
Neutral
The ruling is neutral for the broader cryptocurrency market because it directly concerns Kalshi’s prediction-market contracts rather than the legality or trading of a major cryptoasset. However, it is mildly negative for Kalshi and similar event-contract platforms. The decision strengthens state-level enforcement authority and may increase compliance costs, limit market access, or force platforms to alter their product offerings in the US.
In the short term, traders are unlikely to see a material impact on Bitcoin or major altcoins. Any reaction should be concentrated in prediction-market and crypto-finance platforms with exposure to event contracts. The decision may also raise risk premiums for projects seeking to combine digital assets with regulated betting or derivatives products.
Over the long term, the case could encourage regulatory fragmentation across US states. Similar disputes involving prediction markets, derivatives exchanges, and betting platforms have often produced volatility in affected company valuations without creating sustained moves across the wider crypto market. Clearer federal guidance could eventually reduce uncertainty, but until then, traders should monitor further court decisions, enforcement actions, and the ability of platforms such as Kalshi and Crypto.com to operate under differing state rules.
